The UK’s Competition and Markets Authority (CMA) has decided not to launch an investigation into the Microsoft-Mistral AI partnership. The CMA found that the deal does not grant Microsoft enough control over Mistral to warrant further antitrust scrutiny at this time.
CMA’s decision on the Microsoft-Mistral AI partnership
The CMA’s decision comes after a public consultation period, during which the regulator sought feedback from interested parties on the potential implications of the Microsoft-Mistral AI partnership. The CMA had initially expressed concerns about the growing “interconnected web” of partnerships and investments in the AI industry, prompting a closer examination of the Microsoft-Mistral deal.
Microsoft’s partnership with Mistral AI involves a minority investment and collaboration to make Mistral’s AI models available on Microsoft’s Azure platform. The deal is seen as a strategic move for Microsoft to reduce its reliance on OpenAI, the company behind the popular ChatGPT language model.
In its decision, the CMA stated that “based on the evidence, the CMA does not believe that Microsoft has acquired material influence over Mistral AI as a result of the partnership.”
This conclusion suggests that the CMA found no significant risk of Microsoft gaining excessive control over Mistral’s AI technologies or stifling competition in the AI market.
No formal investigation at this time
The CMA’s decision to clear the Microsoft-Mistral AI partnership without launching a formal investigation is a positive development for both companies. It allows them to proceed with their collaboration without facing regulatory hurdles or potential remedies imposed by the CMA.
However, the CMA’s scrutiny of AI partnerships and investments is far from over. The regulator is still examining Microsoft’s recruitment of key personnel from Inflection AI, as well as Amazon’s $4 billion investment in Anthropic, another AI company. The CMA’s ongoing reviews highlight the increasing regulatory attention being paid to the rapidly evolving AI industry.
As AI technologies continue to advance and become more integrated into various industries, regulators around the world are grappling with the challenge of ensuring fair competition while also fostering innovation. The CMA’s decision on the Microsoft-Mistral AI partnership sets a precedent for how such deals may be evaluated in the future, providing guidance for companies operating in the AI space.
